Do you need probate to sell an inherited house in Texas?
It depends on whether there is a will, what the estate owes and what the title company will accept. Texas has four common routes to a sale.
Independent administration
A will can say that the only court action is probating the will and filing an inventory, and if the will names an executor but leaves that out, all the distributees can agree to independent administration (Estates Code 401.001). The executor then signs the sale.
Muniment of title
When the estate owes no unpaid debt except debt secured by real estate, a court can admit the will as a muniment of title, and people can deal with the heir named in the will as if title were in that heir's name. The applicant files an affidavit within 180 days (Estates Code chapter 257).
Small estate affidavit
When someone dies without a will and the estate, leaving out the homestead and exempt property, is worth $75,000 or less, heirs can use a small estate affidavit 30 days after the death. It passes title to the homestead only when the homestead is the only real property, and it has to be recorded in the deed records (Estates Code chapter 205).
Affidavit of heirship
An affidavit of heirship is recorded in the county where the house sits and becomes prima facie evidence of the facts in it after five years of record (Estates Code chapter 203). Ask the title company whether it will insure a sale on a recent affidavit.
Texas deadlines that affect an estate sale
A will generally cannot be admitted to probate after the fourth anniversary of the death (Estates Code 256.003), and applications for letters face the same four-year limit.
After qualifying, a personal representative publishes notice to creditors within one month and notifies secured creditors within two months, and an administrator can be removed for failing to make final distribution within three years of receiving letters, according to TexasLawHelp.

Who signs when an estate sells a house
With letters from the court, the executor or administrator signs for the estate. Without an administration, the heirs who hold title sign, and the title company tells everyone what it needs to insure the sale.

How selling an inherited Dallas-Fort Worth house works
Send the address
Send the address, the probate status and the names of the heirs or the executor.
We look at the house and the street
We review the house, the recent sales near it and the work it needs, and someone from Provenial gets back to you within 24 hours.
You get a written cash offer
Provenial is the buyer. The offer comes in writing on a Texas purchase contract, usually the Texas Real Estate Commission's One to Four Family Residential Contract, and you decide whether to sign it.
A title company handles the closing
A Texas title company holds the earnest money, runs the title search, pays off any loan or lien from the sale and records the deed with the county clerk.
