What happens to the lease when you sell

The Texas Real Estate Commission's Addendum Regarding Residential Leases has buyer and seller choose whether leases end by closing or carry over to the buyer, and it states that it does not amend or end any existing lease. Provenial buys with the leases in place.

After the sale, the tenant is entitled to the new owner's name and address. Property Code 92.201 requires a landlord to disclose the record title holder within seven days of a written request, by posting it or in the lease.

Security deposits when a rental sells

Under Property Code 92.105, the new owner becomes liable for returning security deposits from the date title passes and has to give each tenant a signed statement with the exact deposit amount. The seller stays liable until the new owner receives the deposit, so the deposits move to Provenial at closing.

Selling with a tenant who stopped paying

Texas evictions go through the justice court in the precinct where the house sits. A tenant who is in default usually gets at least three days' written notice to vacate before the landlord files, unless the lease sets a different period, under Property Code chapter 24, which Senate Bill 38 rewrote effective Jan. 1, 2026.

You can sell before, during or after an eviction case. Tell us where the case stands, and the purchase contract will say who carries it from there.

One rental or a whole portfolio

Provenial bought nine inherited houses in Garland in one purchase and an inherited portfolio of 17 rental properties across Dallas-Fort Worth. See the Garland case study and our rental portfolio page.

How selling a rented house to Provenial works

Send the address

Send the address, the leases and the rent roll. We schedule any walkthrough around the tenant.

We look at the house and the street

We review the house, the recent sales near it and the work it needs, and someone from Provenial gets back to you within 24 hours.

You get a written cash offer

Provenial is the buyer. The offer comes in writing on a Texas purchase contract, usually the Texas Real Estate Commission's One to Four Family Residential Contract, and you decide whether to sign it.

A title company handles the closing

A Texas title company holds the earnest money, runs the title search, pays off any loan or lien from the sale and records the deed with the county clerk.
