How much time you have before a Texas foreclosure sale
Property Code 51.002 sets the steps for a foreclosure sale under a deed of trust. For a house you live in, the lender has to mail a notice of default that gives you at least 20 days to catch up. If the default stays uncured, the notice of sale has to go out at least 21 days before the sale: posted at the courthouse, filed with the county clerk and mailed to you by certified mail.
Sales happen on the first Tuesday of the month between 10 a.m. and 4 p.m., in the area of the county the commissioners court designates. Counties post filed notices of sale on their websites with the date, time and location.
Home equity loans, reverse mortgages and HOA foreclosures go through a court, according to the Texas State Law Library foreclosure guide.

What selling before the sale date does
When you sell before the sale date, the title company asks your lender for a payoff statement and pays the loan off from the sale at closing. What is left after the payoff and closing costs goes to you.
After a foreclosure auction there is no right to buy the house back, except after government, tax-lender or HOA-fee sales, according to TexasLawHelp.
Send the notice of sale with the address if you have one. The sale date tells us how much time the title company has to get the payoff and clear the title.
Texas rules that protect homeowners facing foreclosure
Texas regulates foreclosure consultants, people who charge to stop or delay a sale. Under Business and Commerce Code chapter 21, they need a signed written contract with a notice required by Texas law, and they cannot take a power of attorney or an interest in your house to secure their pay.
The Texas Attorney General warns about foreclosure rescue scams, and federal law bars mortgage relief companies from collecting fees before your lender signs an agreement. Provenial is the buyer of the house and charges sellers no fees.
How a pre-foreclosure sale with Provenial works
Send the address
Send the address, the condition of the house and the notice of sale if you have one.
We look at the house and the street
We review the house, the recent sales near it and the work it needs, and someone from Provenial gets back to you within 24 hours.
You get a written cash offer
Provenial is the buyer. The offer comes in writing on a Texas purchase contract, usually the Texas Real Estate Commission's One to Four Family Residential Contract, and you decide whether to sign it.
A title company handles the closing
A Texas title company holds the earnest money, runs the title search, pays off any loan or lien from the sale and records the deed with the county clerk.
